Evergreen Clause Contracts
Three years ago, I purchased my first home and soon installed an ADT security system. The contract states that after the initial three year obligation the contract will be automatically renewed for one additional year unless written notification is received a minimum of thirty days prior to the end of the initial contract. Having forgotten this cancellation clause over the years, I did not submit a cancellation notice to ADT within the required time frame. My issue is that I would like to discontinue this service because I plan to no longer use a home phone, which is required for operating the system. My previous contract expired two weeks ago. How are these deceptive sales tactics legal and do I have any option other than to pay the fees for the next year.
