Legal Question in Consumer Law in Ohio
I have purchased a good dollar amount of signed sports memorabilia form an individual which I have now determined to have been knowingly forged by this same individual.
I have two questions:
1. What is the statute of limitations on my being able to return these items?
2. If I live in State A and purchased them from him when he lived in State B, but he is now living in State C, in what state do I need to hire an attorney?
We are talking a good amount of money here and I know I need to proceed by hiring an attorney, as this individual is denying everything at this point.
1 Answer from Attorneys
You can sue the Defendant in the state you purchased the items in, or you can sue him in the state in which he currently resides. You naturally will want to hire an attorney in the state in which you sue.
If you sue him in the state in which he lives, then it may be slightly easier to collect upon any assets he has in that state. You should investigate what sort of assets he has before you hire an attorney to sue though. There is an old saying among trial lawyers, "Getting a judgment is fairly easy. Collecting upon it is hard."
