Purchases Used Car from a Private Owner
My daughter purchased a car (on 5/31/02)before she had her licsense. The car sat in our driveway and was only driven twice, (less than 20 miles)and it overheated on 5/9/02. Come to find out the engine is shot, and this engine is ''known'' for this immediatley by every mechanic I call. I signed a ''no warranty'' with the previous owner, but before signing, was told that, ''we are not aware of any major problems'' with the vehicle. Repairs will be anywhere from 1,000-2,000, and she only paid $1,200 for the car. The Owner also told us, after we approached him for a refund, that he is aware of problems, and knew there was a recall on engine when his parents had it, but they never took it in. All mechanics have said the Owner had to know that there was something wrong before he sold to me. Do I have a chance in small claims?

Bottom line, it's worth a shot. Line up mechanics information, get the recall information from the maker or from online, write down all of the Defendants statements to you and use them in court. If you asked, and they failed to disclose known defects or problems, then you might have them. Good luck.
