Legal Question in Consumer Law in Ohio
I had a security system installed in my home. I am paying monthly on it for 3 years. Soon after it was installed, my grandchild opened the door and set off the alarm. At the time, she was 3 yr old. She is now 4, and loves to play and squeal. Her voice will set off the alarm as well A glass breaking in the sink will also set it off, and alert the company. We no longer have a problem with the door, but the battery died in the base. I refused to buy a new one, but was offered a free one. I accepted, but told the rep I spoke to that I would not use it.. I have received a letter from the local authorities that I will be charged for any further false drops, so to avoid further cost, I have not replaced the battery.. What can I do?

You may have some options. The Ohio Consumer Sales Practices Act will protect you from unfair or deceptive trade practices of companies--some of the things that are happening here may fall into that category. You might also have a breach of contract claim against the security company depending on what your contract says. In order to know for sure if there is something you can do, you need to consult with an attorney. Issues such as timing (how long ago the problems started), whether you reported the issues, what your contract says, the number of times you reported the issues, and whether they are required to fix the problem, all matter.
