Legal Question in Credit and Debt Law in Ohio

collection from hosp. who didn't get correct bill. info.

My pediatrician drew blood in her office and then forwarded it to a hospital for analysis. It was my understanding that the labwork would be handled in-house. The hospital did not get billing info from the Dr. and therefore sent the bill to an address I had not been at for 5 years. My insurance was never billed. Now, 2 yrs. later they have put this on my credit report. I had no knowledge of them providing the service and it seems they should have gotten billing info from the referring dr. it is too late to bill the insurance for this. Insurance would have covered this at 100%. I have never received a bill from them. Am I responsible for the hospital's error in billing?

If they reported this unpaid amount to a credit reporting agency they will probably not sue you for the amount. Based upon your statement it seems to me that you have no liability for the bill unless you signed an agreement at the doctor's office to indemnify for any billings from outside parties. What you really need to do though is dispute the reported amount with the credit reporting agency.
