What can I do about fradulent use of my atm card?

I let my husband(we are now separated) use my atm card for withdrawal of 20 dollars in July and since there was very little left in the account I thought he couldn't do anything. A week later I found a receipt in his car stating my atm card had been retained for a status problem. I later found out there had been two fradulent (empty envelopes) deposits made and that I now owed the bank 452 dollars. The bank tells me in order to dig up the videos of when these deposits were made I have to agree to prosecute beforehand. Can I get my money back from my husband because I am pretty sure he did this? How do I go about doing this.. right now I'm in Ca and he is in Ohio where the bank is.

I do not see what the problem is with agreeing to the prosecution. Why would be voluntarily returned money to you when he stole from you to begin with? He is a thief.
