Would an office of an attorney general solicit another law firm to collect a debt owed to the state.

In Ohio, R.C. 109.08 allows the Ohio Attorney General to hire "special counsel" to collect debts owed to the state of Ohio. However, where the debt is a consumer debt (like a debt for medical treatment or for unpaid tuition rather than for a non consumer debt like tax debt) then the special counsel collecting upon that debt must abide by the Fair Debt Collection Practices Act.

My law firm is now involved in a class action lawsuit against the special counsel who are using the Ohio Attorney General's letterhead on their letters to scare consumers into paying off these debts first since the debt collecting law firms are not actually part of the Ohio Attorney General's Office.
