Legal Question in Credit and Debt Law in Ohio
Overdraft Protection
I was contacted by a collection agency over a checking account overdraft protection balance that was charged off in 1997. Is overdraft protection considered an open ended account, therefore beyond the 6 year SOL for Ohio, or a written contract and within the 15 year SOL for written contracts in OH? Not even sure this debt is valid, but want to know my rights

Re: Overdraft Protection
That depends entirely on the agreement that was in force between you and the bank when the account was opened. I would think the 15 year statute would apply, but the agreement in force would control.
