Phone Harrasment

My father is in debt and working 40 hr a week at 77 years old. He has had heart attack/stoke/cancer. Are there ''special'' laws to stop the phone colection agencies when that alone is too stressing? Doctor statements can be made available if necessary?

I understand that within resonable hours and #times per day it is fair game for these people to harrass but it is going to kill my dad. Chapter 7 or 13 not possible due to those legal costs. Help.

You asked if you could stop harrassment by creditors.

There are a number of means to stop harrassment and consultation with an attorney will help. Bankruptcy should not be ruled out because of costs, often those costs can be mitigated with the application of the right knowledge, such as requesting waivers of fees.

First place to start is with a non-profit credit counselor. They must offer services free to persons who cannot pay.

Then you should look at the Fair Debt Collection Practices Act to see how to stop the collection calls, completely. There are also sites which provide information on dealing with harrassing creditors. Keep thorough records of all contacts and actions made by the debt collectors and by your side (a notebook or pad of paper will suffice). You could also change the phone number and get a post office box to help in this matter.

Like I said, an attorney can help and the cost really should not be prohibitive. You may even be able to find a legal clinic that can take the case for free or refer to a lawyer who will take the case for free (pro bono).
