Legal Question in Credit and Debt Law in Ohio

Spouse responsibility

My spouse ran up 50K in debt on two credit cards.

One card is in my name, and one card is in my

spouses' name only.

Am I responsible for both debts, or responsible for the one

in both our names only?

Thank you.

Re: Spouse responsibility

Since Ohio is a not a community property state, you would only be financially responsible for the credit cards in your name. Or, when your wife filled out the credit card application, if you were listed and your income was used in the bank's decision to grant your wife credit, you would be financially responsible for the debt on the credit card.

However, if your wife solely obtained a credit card in her name only, and the credit worthiness was based upon her income only, you would be be financially responsible for the card, even if she obtained a "second" card for you to use. The issuing of "second" cards still makes the original cardholder 100% financially responsible since a "second" card is issued without any basis on credit history or income information.
