Legal Question in Credit and Debt Law in Ohio
Summons Issued
I just received a summons in the mail stating that Asset Acceptance is suing me for an old Comerica credit card. My last payment is listed as 11/14/1995 and it was charged off by original creditor on 6/30/1996. How do I proceed? What is the statute of limitations for this debt in Ohio? Do I need a lawyer to file an answer?

Statute of limitations on an open account is 4 years, while that on a written contract is 15 years. You must admit or deny each numbered paragraph of the Complaint, or you can say you are without knowledge tp either admit or deny the allegation in a specific paragraph. Terms and conditions of a credit card may be construed as a written contract.
