Re: 2 alcohol charges

There are two crimes you have been charged with, although they are inter-related. First is the basic operating a vehicle under the influence (OVI), which is what you think of as DUI. The officer believed that you were impaired when you were operating your car.

The second charge is for having more than the prohibited amount of alcohol in your system. If you took a breath test, this means you blew over a .08.

As you know from your previous DUI case four years ago, these are serious charges that can impact your ability to drive. Fortunately, you can only be convicted of one of these charges, since they are so related. Provided you have no previous DUI convictions, you are looking at a maximum of 6 months in jail and a $1,000 fine, in addition to a license suspension.
