Legal Question in Criminal Law in Ohio

14 daugher charged with possession of drugs

My 14 year old daugher gave her friend $100, the friend bought marijuana in school to resell, my daughter did not know what the money was for. They were both charged with possession of drugs and suspended, and will have to go to court, they say for a felony charge. They have no proof other than the other girls word that my daughter knew what the money was for, she has never been in trouble in her life. Do I need an attorney? What are the potential penalties for this? Will this be on her permanent record? We have a school hearing next week with the superintendent, my daughter never touched or saw the drugs, should she be charged with possession?

Thank you,

Re: 14 daugher charged with possession of drugs

I would strongly urge you to get the help of an attorney with this matter. As things stand now, your daughter has not been charged with a crime -- it is just a school issue. Nevertheless, this is the type of "school issue" that could result in your daughter being suspended or expelled from school. It could also lead to a criminal charge later. Now is the time to nip this issue in the bud. Please do not try to take care of this alone. Anything your daughter says in this school hearing could be used against her later in Court.

I reviewed the other response to this question and could not agree more strongly... You need to be represented at the school issue, and also be in touch with the police closely with an attorney to avoid the charge now!!
