Legal Question in Criminal Law in Ohio

My 13yr old daughter was at the doctors and found a wallet under her chair in the waiting room.The man sitting there had already went into the back to be seen.She didnt tell me about it.She asked me to go to the car to get her Ipod and put the wallet in the car.As we were leaving the police were waiting for us and said they felt it was her that STOLE the wallet since she left and came back in.I asked her and she got it out of the car and gave it to the police officer.The police then took her picture and charged her with a felony theft.The police stated that I will receive court papers in the mail.I dont condone what she did but the charge seems harsh.Is this the right charge or is there finders keepers laws in Ohio.Over all what should or can i do.

It DOES seem a bit harsh. The problem is, she knew who the wallet belonged to be cause he was there. Also, there's probably ID so she could have given it to the doctor. Get a lawyer and fight it.
