aggravated vehicular assault

Eight yrs ago my brother in law was charged w/ aggr. veh. assault after he crippled a 13yr old boy that he hit while driving intoxicated. He served 18mo., lost his license for life, and will owe $$ forever. A few mths ago the boy died. Now their trying to open a new case of Agg. veh. hom.. Isnt there some kind of statutes of limitations or dble jeapordy law on this? How can he be recharged for the same crime?

I don't believe they will succeed in re-opening the case BUT it would have to be researched to know for sure.
