Legal Question in Criminal Law in Ohio

appeal

I am no longer able to afford council for my appeal.I applied for court appointed council, w/ a family of 6, and monthly bills that exceed my income. I was denied because my $1100 a month income is too much by the judge whose unethical actions I am appealing, and I was informed that all court appointed council is at his personal discretion. What options do I have now?

Appointment of Counsel is done either by the trial court or by the Court of Appeals. If you have already filed a notice of appeal, you could file a motion with the Court of Appeals.

Your trial attorney should be willing to help you file the notice of appeal and the motion for appointed counsel with the Court of Appeals.

If you do not qualify for appointed counsel and cannot afford to hire an attorney there are only two options: (1) do the appeal yourself, or (2) try to get some law school or pro bono legal service to help you.

At this point, your best option is to ask the Court of Appeals for appointed counsel.
