Legal Question in Criminal Law in Ohio
arrestee drug test in hospital
my question is in regards to whether or not is lawful (in the state of ohio), for officers of the law to request a drug test of an arrestee who had to be taken to the hospital, to charge the requested drug screening to the arrestee, and then to use that drug test against them in court? isn't there a privacy policy in hospitals? and shouldn't the officers have requested a drug screening specifically from the said person involved outside of the hospital instead of within?

There should have been a warrant to receive this information, unless the test was done for some medical reason. Your question raises a critical issue that demands an attorney's examination.
