You asked if a misdemeanor offense can turn into a felony offense. Sometimes the initial arrest is made before all of the facts are known. Occasionally additional facts come to light that make the offense conduct a felony instead of a misdemeanor. In those circumstances, the charge can increase from a misdemeanor to a felony charge. Normally that happens when the prosecutor seeks an indictment.
