Re: Ohio Bigamy or Polygamy Penalty

Stepfather is serving time in jail for attempted murder w/handgun, felonious assault, etc on family. At an early motion for release hearing, his attorneys state he is ''married recently'' to another lady we've never seen. He has been together, considered married, filed joint tax returns, have kids together w/my mom since 1979. Ohio has common law marriage prior to 10/91. Has he criminated himself in jail? Can this add to his jail time?

Common law marriage was recognized in Ohio by a court determination. For example, if there had been a dispute regarding the nature of the relationship and property division, one party could have sued the other for a divorce alleging that a common law marriage existed. Because there was no court determination of a common law marriage, it did not exist.

There is no crime.
