Legal Question in Criminal Law in Ohio
My brother is currently serving two years. He and his wife received their income tax check. Since she was unable to cash it, he gave my dad power of attorney . They would go to the bank, deposit the check and my dad would write her a check for half. They signed the check, but the bank would not deposit it.The check was given back to her signed. My brother was getting help from the prison admistrators to write a letter to the IRS to have the check put in her name with the understanding she was to give my dad half for my brother since he had power of attorney.Before the letter was written, she cashed the check and now will not give my dad hald. My brother is paying for his crime, but he does not deserve this. Please, is there something we can do to help him.

Was there anything in writing that said that she would give your dad one-half of the money? If she does not want to give the money up then you would need to take legal action against her. I would be able to help you in this.
