Called outside to be arrested
Four of us went out to breakfast in Highland Hts OH two went to pay the tab. when they came back they said the tab was paid. I looked at the receipt it read 4 guest total $16.43 total due was BLANK. They left the resturant and waited in the car. My girlfriend and I waited for a carry-out container then went to the car. The manager,security and a employee came to the car and said my girlfiend and I needed to come in and pay our tab I showed them the receipt and said they paid the tab.The manager said they only paid for two and you need to come and pay for you two. My girlriend and I went back inside As we were standing in line the manager stood behind us and said ''If you don't leave my waitress a heffty tip I will prosecute you'' I told him I would pay my tab but it won't be a heffy tip I'll leave her the change from this 20 dollar bill. My date left the line to get her purse from the car. once outside the police put her in hand cuffs I got out of line and went to the window and the police motions me to come outside,when i came outside he took the money from my hand stuffed it in my pocket took the receipt and said u r under arrest. We were arrested. charged w/petty theft. Is this against the law he told me to come outside.

It sounds like place that you were eating at is one frequented by the police officers. They probably wanted to make a good impression. Was what they did legal? Does not sound like it. But you are still facing serious criminal charges and should talk to an attorney ASAP if you have not already done so. Even though the charge is misdemeanor, having a theft offense on your record is devastating.
