i had a friend of mine take over a car payment for me and know i found out that he hasn't been paying the payment and he won't give the car back will i go to jail oh also the by here pay here lot knew he took over the payment

Unles he signed something they will come after you and not him for the balance. You won't go to jail for a debt.
