cgarged yesterday 2 msdemeanors now told have a felony on the way same incident

I was busted in a raid with a small amount of pot.all of mine and other members of households' cash was confinscated til after investigation. one member in the house told officers that pot he had on him came from me. i was arrested a few days ago and went to court for this 5 month old incident and plead guilty to the charges of possession and paraphanelia got community service and d/l suspension.The judge ordered in writing our money be returned, however when contacting the sherrif they told me we could not have it returned as felony trafficking charges were pending against me.

MY question is

A: is this legally accurate( why wasnt i charged all at once)

B:will this violate my suspended jail time from my 2 day old sentence being as though it would be for the same incident

NO worries about the probation since it is same incident. Your friend's statement could be used against you to get trafficking, but you cannot take that. HE needs to testify that you gave it to him - that's not a felony to give.
