Legal Question in Criminal Law in Ohio
Change in sentence.
Say that a person pled guilty to a felony of the third degree. For the charge, they are given a year to do in prison with a signature release. A presentence investigation is done. This is the person's first offense and the person has no previous criminal background, no type of drug/alcohol use and makes an honest living. Is it possible that probation or some other form of punishment can be given instead of prison time during the sentencing trial?

Yes. For most third degree felonies, there is neither a presumption for or against prison. If the person has no record, probation is probably an option.
