Legal Question in Criminal Law in Ohio
Charged for Borrowing?
My Brother-in_law was told by his supervisors at work that he could borrow anything he needed anytime, and so were other employees at this workplace. Anyway he borrowed a chainsaw and when he was done with it he let another co-worker use it and this other co-worker was supposed to take the chainsaw back to the place of employment when he was done with it. My brother in law or his wife never thought anything else about it until just the other day when The other co worker who took the chiansaw sold it to an undercover police detective. And when asked who he got the chainsaw from in the first place the guy told them he had gotten it from my brother in law. Now they're trying to put the same charges on my brother in law that they're putting on his co worker,. I don';t think they can do that since my brother in law didn't sell the thing or even know that the guy would even consider selling it. Could you please explain to me what my brother in law could be charged with or why he would get charged for anything?

Unless he appears with an attorney to make a statement before he is charged, he will be charged. That is always up tot he police.
Once he is charged he merely has to defend himself, but the police alone make the decision to charge.
