Legal Question in Criminal Law in Ohio

Clerical error for request to appear for hearing

My parents and I have been requested to appear at an unofficial hearing because I have been charged with receiving stolen property. The date on the letter though has passed before the letter was even sent (appears it should be 02 instead of 01 which they have).

The question is do I have to appear at this hearing? Will it do me any good not to appear? Can the case be thrown out for such a small error?

Signed, Confused

Do not appear without counsel. It can do no good to speak to the prosecutor without counsel. One does not want to suffer from foot in mouth disease.

Good Luck!!!!!!!!!!!!!

Re: Clerical error for request to appear for hearing

I suggest that you not ignore the notice to appear before an Unofficial Hearing, (or any Court Summons, for that matter.) I assume you are a juvenile. The Unofficial Program offers you the opportunity to avoid the official Juvenile Court system for Juveniles charged with an offense for the first-time. I suggest you call the Court and advise them that there appears to be a typographical error. If you were served with the Summons in error, the Court will inform you. If not, the Court will correct the error and advise you of the proper date and time.
