contract fraud

i took money down on a contract for work i was to do . the money was miss managed by me and the supplies were never ordered. i went to the people and told them and gave them the option of letting me do the work or paying them back,they opted the get payed back.i have given them one payement so far. can they still get me for fraud in ohio.

Maybe. Fraud really depends on what you knew, when you knew it and what was said to the party to induce them into their actions. If it can be shown that you knew or intended to use the money for something other than what it was intended for, yes fraud is a possibility. If it was an honest mistake after you received the money, it technically isn't fraud, but could be another legal issue. The reason fraud is so bad is that not only can the party recover it's money, but they can also recover 'punitive' damages which are provided to punish the wrongdoer... those can get expensive depending on the act.
