Legal Question in Criminal Law in Ohio
I was convicted of felony theft nearly 10 years ago. The record has been sealed. Will this show up on a FBI background check for employment?
1 Answer from Attorneys
It depends on the quality of the sealing. And it depends on the security level your new job will entail. You did not say in which state/county/court the "sealing" occurred. There is a great divide within the nation's court systems on how good records are processed. Some require effort from YOU to make sure that the records are not found.
I am sorry I could not give you an accurate answer but it is my view that you need not disclose the felony on your employment application because it was sealed. The employer, if the felony is found, may feel differently but at least you have an argument that you did not falsify the employment application.
