is there a criminal penalty for trying to give an unknowing person o.t.c. sleeping medicine?

This could be considered assault. The particular level of assault would probably depend on the injury inflicted upon the "unknowing person". Further, there is something called civil assault which is a cause-of-action for a lawsuit. What is unclear from your facts is if the person actually took the medication. If he/she did not, I suppose you could be charged with attempted assault (but I have never run up against such a fact pattern).
