How can I have a feloney removed from my record?I have made total restitution legally and financially.

Under the statute for expungement, the offense must have been your first offense, EVER. THis does not include minor misdemeanors and traffic tickets. BUt if you have ever been convicted for DUI, DUS, and a few other more serious mva offenses, you are not eligable. If you were not eligable for probation at the time of your sentencing, you are most likely not eligable for expungement.

Also, you can not apply for expungement until 3 years after your final discharge from the court. This means that after restitution, jail, etc, whatever your sentence was, you have to wait 3 years from the date everything is done with before applying for expungement.

There is also a fee usually around $50. that is set by the court.
