Expongement

Two months after my 18th birthday I was involved in a B&E. It was in a auction house and $300.00 of merchandise was taken ands later recovered.I inturn pleaded guilty and received a 5 year probation which was lifted after 4 years. I had my record exponged after 15 years.I have not been involved in any other criminal activity. I am now 59 year and put in for a CCW in the state of Ohio. My aplication was turned down because of my record of 40 years ago. Please advise. Thank you.

Sir:

If you record was sealed/expunged, you should be eligible for a Concealed Handgun License (CHL). I recently represented a client with the same problem and was sucessful upon appeal in obtaining a CHL for him. You have a very limited time frame (15 days) to appeal the Sheriff's decision to Common Pleas Court. If I can be of assistance to you, please call (614) 476-6453.

If your record was expunged then you should be eligible for a concealed carry permit. You can appeal the denial, but there are some fairly strict time limits. I have had a couple of clients who were denied because the agency did not know that their record of felony conviction had been sealed. When we got the record corrected, they were approved.

You can appeal this yourself, or hire an attorney to help you.
