Legal Question in Criminal Law in Ohio
Does an eyewithness minor supoena'd to court have to attend?
My 10 year old was the eyewitness to a robbery of a purse being stolen from a car in our neighborhood. He positively I.D. the guy for the Police, and now he received a subpoena to show in court next month. My son has had nightmares over the robbery he saw, and is scared of every little noise he hears. We want to help convict this guy, however do not want to subject my 10 year old to a face to face confrontation in a courtroom. I would rather have him talk to the prosecuting attorney in his office. My call to the attorney got me nowhere- he said he HAS to go to court. Does a minor?? Please advise, Thank-you!

I suggest that you get an attorney on this ASAP. Your son does have some rights here but you can not count on the prosecutor to look out for your son. His job is to convict the guy. Your job is to protect your son.
Feel free to give me a call if you like but it is important that you talk directly to an attorney on this and I think that you may need to spend the money to get an attorney on board.
Good Luck
