Legal Question in Criminal Law in Ohio
felony gun charge
My ex husband was convicted of a felony of drug traffic (cocaine) from 1981-last week he was found with a gun and charged with gun possession under disability. He has guns in others names to be able to obtain-he is trying to show the gun is not his, but it is. If convicted of this 2nd felony could he just get probation or must he do jail times since it would be a second felony

Jail time is not mandatory for such an offense so he could get probation. After all, it HAS been 26 years since his drug trafficking conviction. What county is this in? And what were the circumstances of the alleged possession?
