Legal Question in Criminal Law in Ohio
my friend is being charged with unlawful sexual conduct with a minor for the second time what is the number of years he may be looking at in prison?
1 Answer from Attorneys
It depends on a couple factors. First, was he convicted of the offense on the first charge? If so, this time it could be charged as a second degree felony which carries up to 8 years in prison. The other factor is the age difference between the person charged and the alleged victim. Less than four years difference and the charge is a first degree misdemeanor. More than four but less than 10 year difference is charged as a fourth degree felony. If more than a 10 year difference, it will be charged as a third degree felony.
So, depending on the circumstances hens facing anywhere from 6 months to 8 years.
