Legal Question in Criminal Law in Ohio
a friend of mine was caught with a bunch of xanax she went to jail and got released, she rescheduled her arraignment court date but when she went down to the court to be added to the docket she was told it was dismissed and she would receive papers in the mail about a furture indictment. what exactly does a future indictment mean?
1 Answer from Attorneys
When a case is dismissed for future indictment it just means that the prosecutor's office has decided not to present the case to a grand jury right now or proceed with a preliminary hearing to have the defendant bound over. The case is dismissed because the municipal court does not have jurisdiction over the felony in the complaint.
The defendant will receive a summons in the future when the case has been indicted to appear to answer the charges and should keep watch for this to avoid a warrant.
