Legal Question in Criminal Law in Ohio
Hello,
I would like to know how a criminal misdemeanor differs from a criminal felony? Also is rape considered by law a felony and would not be tried in a municipal court as a misdemeanor?

All misdemeanors and felonies are tiered. There are five levels of misdemeanors in the State of Ohio and the highest level of punishment is for an M-1 up to 6 months in jail and a $1,000 fine. Depending on the charge, rape, gross sexual imposition, attempted rape, sexual imposition, will determine the degree of charge and therefore the base potential punishment. If you are under investigation or someone you know is under investigation, please retain counsel as soon as possible.
