Legal Question in Criminal Law in Ohio
my husband has been arrested for sexual battery with a minor and he was involved in the local school. i am going to divorce him but if i am supeonaed, will i have to testify for him

He has what is known as spousal privilege. That is, he can stop you from testifying against him. But if he allows testimony you must tell the truth and that could go AGAINST him not necessarily FOR him. He can not pick and choose what you are going to say.
