Legal Question in Criminal Law in Ohio

Indicted of charges not commited

Hello, I have a friend who is being

indicted on the charge of committing

mortgage fraud. My friend worked for

a law firm part-time, at the time he

was separating from a relationship

which pushed him to get a mortgage

and buy out his other half as well as

dealing with his father's passing. He

went to his attorney and boss at the

time and said I can't get a loan at the

moment. Attorney/Boss agreed to

give him a raise and make him

permanent for him to be able to get a

mortgage. Verification of employment

stated the amount of income totaled

with raise. Loan was approved but he

only got half the amount of raise

promised, then terrible thing

happened, he was wrongfully

terminated along with other

employees. He was forced to

foreclose and now they're charging

him for mortgage fraud for stating

wrong income. He lost his home, his

good credit and now he might even

lose more. His only fault was the fact

he wasn't in the right state of mind

(due to his father's death) when

signing the loan papers at closing

with his atty/boss present. He

trusted his atty to give him the best

legal advice, not make his life such a

mess. Does he have any legal basis

to fight this?

It doesnt sound like he intended to commit fraud so he needs a lawyer to fight for him. If it at the time he was telling the truth, it doesnt matter if it turned out not to be the case. Call me directly if you like. 216.952.1990
