under the influence

my son was recently arrested for being under the influence of drugs. However, he says he was not. The other two teens that were with him confirm. They gave him a pin test...is this a legal and accurate test? How do I defend him? He had no drugs on him but the other teen did.

You do not indicate whether your son is an adult or a juvenile. You also do not indicate the actual charge. Was he charged with disorderly conduct, driving while under influence of drugs, or some other charge?

The law regarding what is proper evidence to prove that your son was under the influence of drugs is complicated. You should hire an attorney for your son. If you cannot afford an attorney, you should ask the court to appoint an attorney to represent your son.

Since the evidence against him is weak, an attorney should be able to reduce the offense or even have it dismissed, but I would not expect that without an attorney to press that issue.
