Legal Question in Criminal Law in Ohio
Juvenile theft from my home
One of my 13 year old daughter's friend took my cell phone and had a texting party. 2900 of them in 7 day period. At first she denied any knowledge of the phone, several days later, after I had called all the numbers and they all confirmed it was her using the phone, she changed her tune--now all of a sudden - my daughter let her use the phone. Can I pursue criminal charges against this child, because I have tried speaking with the parents about it, now that she is saying that their daughter had permission to use the phone, they are not going to pay the bill. Dealing with the financial part of it is secondary to me, I want to get to the truth have the young girl take responsibilty for her actions. Can I file criminal charges against this teenager?

You can contact the police and the county prosecutor's office. The problem will be whether, in fact, your daughter granted permission. If you are certain that she did not, then it is appropriate to contact the police and the prosecutor.
By the way, the parents are responsible for up to $3,000.00 of the harm caused by this girl's actions.
