Kicked in Fender/Criminal damaging

A person kicked my fender in and I called the police after finding out it was him. the police went to his house and he agreed to pay for it and the cop told me it would probly be better to settle it out of court, so i did. i have called, left messages, and given him the estimate. he wants it pulled out so he can get it done free by a friend but i went to a professinal and he said you need a new fender. so my question is after deciding to settle out of court can i still take him to court?

Was he ever charged? If not go back to the police and file a complaint there. Restitution from a criminal case is collectible, while a civil judgment is difficult, if not impossible, to collect.
