Legal Question in Criminal Law in Ohio
How long till this is over?
7/12/05 Arrested; 5 mos later arraigned felony 4 (drug offense); case dismissed 05/07/07. I am aware that the prosecutor can reindict but how long do they have to do this and from what event does the counting start? (arrest date arraignment date?) If it does stay dissmissed how do I expunge it or eliminate it from public view on the county website? Please help, and thank you in advance for your time and input.

Statute of limitations would control on how long the prosecutor has to re-indict. That would be 6 years from the original offense date. If the charge was dismissed, I don't believe you would have to wait the uaual two years to attempt an expungement. I believe you could ask to have the record sealed at any time. If you are intrested in trying that, I believe I could give you a reasonable price.
