When I was questioned by the state trooper, both time he did not ask me if I wanted a lawyer or that I had the right to remain silant. Didn't the trooper make an error that could set me free if I am convicted.

Re: Meranda
It depends where and under what circumstances the questioning took place. And if your Miranda rights were violated, it wouldn't necessarily mean that you would win the case. All the court would do would be to exclude any incriminating statements that you might have made while being questioned by the trooper. It's possible that the remaining evidence would still be enough to convict you.
