Operating a Gambling House
Hi,I have a ? for my father
He is 62 never been in trouble in his life
WE live in Ohio,and he was helping run a local Charity Vegas Nights In our area,they came in and did a raid,and they arrested him for operating a illegal Gambling house,They searched his car,and everything on him,found nothing,then they took all the players chips,and told them tough luck,I forgot to mention the reason he was arrested,was because they said they were taking the chips,and he demanded the people get a receipt for their chips to get there money back,they said we will have to arrest you then,and he said fine,
WEll he got right out,and went to the arranigment,he plead not guilty,then it was set for pre trial,he did retain a attorney,they still made no deal,now it is going to trial,They said he faces 6 months in jail,and a 1500.00 it is a 1st degree Misdemeanor
I am terrifed for he is not jail material,and was doing nothing wrong,what is his chances for jail,thank You

Like the previous atty's response I don't see your father going to jail. He just needs to be respectful in court. He should actually be eligible for a first offender program depending on what city he is being charged.

Your father's age and clean record will really help him. Without knowing all the details of his case and the judge in which he is front of, I cannot really predict with any certainty what kind of sentence he will receive. I can tell you though that the penalties you noted are the maximum he can receive. In the vast majority of cases, persons convicted of crimes do not receive maximum sentences.
