Do I still have to pay the fine if I've already done the time?
I was recently incarcerated for a violation of probation. I served 5 months on an 8 month sentence before being approved for judicial release. I am back on probation now and my fines and community service obligations have been reinstated. Doesn't the 5 months served count for a reduction or elimination of the fines and/or the community service obligations? If so, what type of motion can I submit to the courts for their reduction or elimination?

Unfortunately, payment of fines and costs etc., are discretionary with the Court. The Court should credit you for the time you have already served, however, the Court does not have to grant the motion. It is called a motion for reconsideration. A lot will depend upon on what the violation was. The fines etc., may be for the new offense. You should ask your probation officer for an accounting.
