Legal Question in Criminal Law in Ohio

post divorce violence

I've been divorced for a year and a half. My ex will not rest until I'm in jail. Everytime I go to the house to pick up my kids, she verbally attacks me and occasionally assaults me. Is it possible to get a restraining order that says she can't come within 20 or 30 feet of me?

How do I get a restraining order?

You can also file for a civil protective order which would require her to abstain from any assaults against you and have to maintain a certain distance from you. It may also require a third party to facilitate in the pick up and drop off of your children.

You really have two choices: (1) go back to the divorce judge and seek a contempt of court for her actions; or (2) next time she assaults you, call the police and charge her with domestic violence. If you decide to follow the second option, make sure you have a witness so that it is not your word against hers.
