I had a power of attorney and was on the bank account can I be prosicuted for using some of her money?

If you used her money soley for yourself, yep, you can be prosecuted AND sued. As a power-of-attorney you have what is called a fiduciary responsibility. Absent consent by the principal, you can not use this money for your own benefit.
