The answer depends on where the offense occurred, and whether it was charged under the State Code or under a Municipal Ordinance. Under the state Code the possession would probably be a minor misdemeanor, which carries the possiblity of a $150.00 fine, court costs, 30 hours of community service, and loss of driving privileges. The paraphernalia charge under the State Code is probably an M-4, which means up to 30 days in jail, a fine of up to $250.00, court costs, and loss of driving privileges. The punishment could be greater under a Municipal ordinance.
