Legal Question in Criminal Law in Ohio
Safety Belts
I would like varification on the Seat belt law. I am a police officer and would like to know if the seat belt is a primary offense or probable cause to stop a motorist just for this offense.
Thanks,

Re: Safety Belts
After reviewing the statute, 4513.263, I don't believe a seatbelt violation can be used to establish probable cause for an arrest or a search. See specifically section D.
