Legal Question in Criminal Law in Ohio

scary brother-in-law

I have a brother-in-law who is a terrible drug addict. He is 50 years old and has been in trouble with the law his entire life. He is living with his parents and doing drugs in their home. He is threatening to take their home and has established residency by having his mailing address there. His sister tried to get him out of the house because he is violent often and she is afraid he will harm their mother and father. She shoved him. He picked her up by the neck and threw her to the ground. Then he had her arrested because she touched him first. Is there any way to force him out of the house? We are all afraid he is going to hurt his parents. His father has already suffered a stroke from the stress. Any advise would be greatly appreciated.

Based on what you told me, no there is no way he can get the home. All it appears that he has done is establish residency by changing his mailing address to this home. I am assuming the parents own the home and the brother-in-law does not have any legal title to it. My best advice is to get a protective order against him from the parents. That is all I can say based on the facts you have given me.
